Our work highlights

  • Acting for Ernst & Young in High Court proceedings brought by the Fuji Xerox companies against former directors of Fuji Xerox and Ernst & Young as its auditors, with alleged losses exceeding $250 million.

  • Acting for a defendant in the Feltex shareholder class action High Court trial.  Subsequently acting on the successful appeals to the Court of Appeal and Supreme Court (Houghton v Saunders [2014] NZHC 2229, [2015] 2 NZLR 74; Houghton v Saunders [2016] NZCA 493, [2017] 2 NZLR 189; Houghton v Saunders [2018] NZSC 74).

  • Acting in the High Court, Court of Appeal and Supreme Court hearings in relation to champerty/maintenance and litigation funding issues (Walker v Forbes [2015] NZHC 1730, (2015) 22 PRNZ 660; PricewaterhouseCoopers v Walker [2017] NZSC 151).

 
  • Acting for an investor in finance company, FE Investments Limited, and recovering a substantial portion of its investment and interest after it became evident that the company was in serious financial difficulty and was being mismanaged before collapsing.

  • Acting for the D&O insurers of directors of a large construction group in relation to several claims against the directors arising from the collapse of the group and the liquidation of a number of entities within the group.  The liquidators allege that the directors are liable for losses over $80 million.
